Categories of Information Sold to or Shared with Third Parties.

The terms “sell” and “share” are defined in the CCPA (CA Civ. 1798 et seq.).

In the preceding 12 months we have not sold your personally identifiable information. Also, we do not knowingly sell or share the personal information of consumers under 16 years of age.

In the preceding 12 months we have shared your personally identifiable information that we have collected with service providers. This information is collected when you visit and interact with our Website, use our products, click on our advertisements, or open our emails. The information we collect may include personal information, or we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us improve our Website to deliver a better and more personalized service. The collected information may include:

  1. information about your computing device and Internet connection, such as your IP address, browser type and version, browser plug-in types/versions, operating system and platform, device type, and advertising ID;
  2. details of your visits to and use of our Website, including traffic data, IP-based location information regarding the city, state or country from which you access our Website to feature local retailers in your general vicinity, date and time of your visit, log data, error information, and other communication data, as well as the resources that you access, use, or otherwise interact with on or through our Website;
  3. information about the content you view and the features you access (for example, details regarding the advertisements you have interacted with, viewed or accessed, such as the number of times you view an advertisement); and
  4. information reflecting your preferences, trends, activity, and/or behavior while using the Website.

Our service providers, partners, and we engage in automatic data collection to provide content, advertising, functionality, and other services that measure and analyze ad performance or user behavior on the Website, and may use cookies and/or web beacons to understand usage of the Website and improve our content and offerings and to deliver advertisements in which you might be interested. These technologies collect statistical and other information, including personal information, about you and your use of the Website. Some of the technologies we and our service providers or partners may use include:

  1. Cookies (or browser cookies). A cookie assigns a unique identifier to your web browser or device and may enable us, our vendors, or third parties to recognize you as the same user who has used the Website and relate your use of the Website to other information about you, such as your usage information and other personal information. We may use cookies in a variety of ways. For example, we may use cookies to: provide us with information about which portions of our Website are the most popular by enabling us to see what web pages a user visits and how much time a user spends on each page; personalize your experience on our Website (for example, to recognize you by name when you return to our site, to save your password in password-protected areas, to enable shopping carts, or to tailor content, or product and service offerings); help us advertise to you and understand which ads you have seen; help keep track of items you put into your shopping cart, including when you have abandoned your cart and this information is used to determine when to send cart reminder messages.
  2. Web Beacons. A web collects anonymous and aggregate advertising metrics, such as the counting of page views, promotion views, or advertising responses. Web beacons can recognize certain types of information, such as a user’s cookie number, time and date of a page view, and description of the page where the web beacon is placed. These web beacons may be used to deliver cookies. Pages of our Website and our e-mails may contain web beacons.

These tracking technologies described above may be deployed by us and/or by our service providers or partners on our behalf. These technologies enable us to assign a unique number to you and may allow us to relate your use of the Website to other information about you, including your usage information and other personal information. We may match information collected from you through different means or at different times and combine such information with information obtained from other sources (including third parties), such as demographic information and updated contact information (where that information has been lawfully disclosed to us), for the purposes of learning more about you so we can provide you with relevant content.

You have the following rights as a California consumer:

  • Right to know what personal information the business has collected about you, including: the categories of personal information we have collected; the categories of sources from which the personal information is collected; the business or commercial purpose for collecting, selling, or sharing personal information; the categories of third parties to whom we disclose personal information; and the specific pieces of personal information we have collected about you.

  7. Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
  8. Comply with an existing legal obligation; or
  9. Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.
  • Right to correct inaccurate personal information that we maintain about you. Upon receipt of a verifiable request from you, we will use commercially reasonable efforts to correct the inaccurate personal information.
  • Right to opt-out of the sale or sharing of your personal information for cross-contextual behavioral advertising.
  • Right not to receive discriminatory treatment for exercising any of these rights. This means we cannot, among other things:
  1. Deny goods or services to you;

  3. Provide a different level or quality of goods or services to you; or
  4. Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

Please note that we may charge a different price or rate or provide a different level or quality of goods or services to you, if that difference is reasonably related to the value provided to our business by your personal information. We may also offer loyalty, rewards, premium features, discounts, or club card programs consistent with these rights or payments as compensation, for the collection of personal information, the sale of personal information, or the retention of personal information.

How to Exercise Your Rights.

You can submit a request to exercise your rights to access, correct, or delete your personal information by sending an email to support@oneillclothing.com and providing us with your name, address, phone number, email or using one of the following methods:

To opt-out of the sharing of your personal information, click on this link: Your Privacy Choices

Additionally, if the Global Privacy Control opt-out preference signal for your browser is enabled, we will treat this as a request to opt-out of activity that may be considered “sharing” of personal information or other uses that may be considered targeted advertising for the device and browser you used to visit our website.

Verification of Your Identify

We will need your contact information, including your name, address, phone number, and/or email, to verify your identity for access, correction, or deletion requests. We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information or is someone authorized to act on such person’s behalf. Any personal information we collect from you to verify your identity in connection with your request will be used solely for the purposes of verification.

Authorized Agent Request

If you are an authorized agent, then you will be required to submit your contact information and complete a certification form as well as provide information about the consumer for whom you are making a request.

Retaining Your Personal Information

Your account will remain in our system as long as you are a customer. Let us know when you no longer want to be a customer and we will delete your personal information in a reasonable timeframe (unless otherwise specified through a Privacy Rights request). We may be required to retain certain records by law for business purposes, such as satisfying legal, accounting, or reporting requirements, but we won’t retain them for longer than necessary.

Notice of Financial Incentive

We may offer certain programs, benefits, and promotions (such as discounts, exclusive offers, or early access to products) in exchange for your voluntary participation and the collection of certain personal information, such as your name, email address, or phone number.

Participation in these programs is entirely optional, and you may opt out at any time by following the instructions provided in the applicable communication or by contacting us.

Under California law, these programs may be considered “financial incentive” programs because they involve the collection of personal information in exchange for a benefit. We do not assign a direct monetary value to your personal information. However, we have found that being able to stay in touch with customers about these programs results in happier, long-term customers, which is a fair exchange for the discounts that customers receive.

You can withdraw from participation in a program at any time without penalty by unsubscribing from communications or contacting us using the information provided in our Privacy Policy.
